MDR LAW and Erickson Law are representing the Plaintiff in a wrongful death claim against Winnebago County Sheriff Gary Caruana and several other Winnebago County Jail employees. A daughter is bringing the wrongful death suit on behalf of her father whose civil rights were violated. As a pre-trial detainee, her father passed away while incarcerated at the Winnebago County Jail.

What Happened During Ted Wise’s Final Days?

Around October 31, 2022, the individual, now deceased and aged 61 with multiple health issues, was detained on a misdemeanor bond-forfeiture warrant in Winnebago County.

Shortly after he entered Winnebago County Jail, he started encountering evident and severe health problems. Over the course of the next seven days, his health not only didn’t improve but continued to deteriorate. However, despite pleas from the now-deceased individual and his cellmate throughout this time, the Winnebago County Jail staff neglected the inmate's deteriorating condition.

On November 6, 2022, the Plaintiff's father tragically collapsed in his jail cell and was pronounced dead. The wrongful death lawsuit alleges that the negligence and misconduct of Winnebago County Jail staff directly contributed to the father's death and the unnecessary pain and suffering he endured leading up to it.

How Can a Wrongful Death Claim Help?

Unfortunately, the Winnebago County State’s Attorney’s Office decided not to file criminal charges against anyone involved in this case. As such, the only other way that the Plaintiff could hold those who she believes are responsible for her father’s death, pain, and suffering accountable is to file a wrongful death claim against them.
