Chicago Charter Vehicle Requirements

Chicago Municipal Code Chapter 9-114 requires a Charter/Sightseeing Vehicle License for party buses and charter or tour buses with capacity for 10 or more people. Consumers can check Chicago’s Public Passenger Vehicle License database to determine whether a vehicle is licensed.

Additional safeguards apply to certain alcohol-related trips. Under Chicago Municipal Code 9-114-320(b), a trip involving 15 or more passengers where alcohol may be consumed onboard or during a stop requires a security guard, a fully operational security camera, and a written safety plan available for inspection. Licensing and safety records can show how the trip was organized and whether the operator followed applicable requirements.

What to Do After a Chicago Party Bus Crash

Call 911 and seek medical attention after a bus crash. Some injuries aren’t immediately apparent, and medical records provide a contemporaneous account of your symptoms, evaluation, and treatment. Keep copies of medical records, bills, discharge instructions, and work restrictions.

If it’s safe, photograph or record the crash scene. Capture the bus company’s name, vehicle information, visible damage, road conditions, and identifying information displayed on the bus. Obtain contact information from passengers, pedestrians, motorists, and other witnesses.

Report the incident to the bus company, but keep the report factual. Don’t provide a recorded statement to an insurance adjuster before speaking with an attorney. An adjuster may ask questions before you know the extent of your injuries or have access to records explaining the crash.

Preserving Onboard & Transportation Records

Onboard surveillance footage, GPS records, and driver logs may be retained for only a limited period. Video can be overwritten, and routine data practices can erase electronic information unless preservation efforts begin promptly. Illinois Deadlines, Damages & the Claim Process

An injury claim against a private party bus operator is generally subject to Illinois’s two-year personal injury filing deadline under 735 ILCS 5/13-202. The precise deadline can depend on the parties and circumstances. A claim involving a public operator such as the CTA follows different rules, including a one-year deadline under the Metropolitan Transit Authority Act, so confirming the operator’s identity early is important.

Comparative Negligence

Illinois follows modified comparative negligence, which assigns percentages of fault when more than one party contributed to an injury. An injured person can generally recover damages when 50% or less at fault, but the recovery is reduced by that person’s assigned percentage. Someone found more than 50% at fault generally can’t recover under this rule.
