MDR LAW Victory in Appellate Court Gives Our Client Their Day in Court

We are thrilled to announce a significant victory for our client as attorneys Marty Lucas and Florina Bandula successfully appealed an order dismissing a crucial complaint. The case involved allegations against a local high school district for its failure to prevent a teacher from engaging in sexual abuse against the Plaintiff during their time as a student.

The Plaintiff detailed a disturbing pattern of grooming and abuse, while the defendant school district argued that it had no knowledge of the teacher's misconduct. Relying on the Illinois Local Government Tort Immunity Act, the school district claimed immunity for discretionary decisions related to the accused teacher, leading to a motion to dismiss being granted by the trial court.

However, our tenacious legal team at MDR LAW LLC persevered, appealing the decision to the Appellate Court. The Appellate Court not only disagreed with the trial court's ruling but also returned the case, providing our client with the opportunity to conduct full discovery related to their allegations. Importantly, the Appellate Court supported our argument that there should be no immunity based on discretionary acts when the defendant insists it had no knowledge of the harmful conduct.
